The wife of the petitioner died in harness on 15.04.2015 while working as Assistant Teacher, Mahendra Middle School, Chapra, Saran. The petitioner has filed the instant application for payment of group insurance amount of his wife along with interest thereon.

It is submitted by learned counsel for the petitioner that pursuant to the order passed in this case on 21.07.2017, the amount under the head of group insurance has been paid to the petitioner but without interest. As such prayer is made that the respondents be directed to make payment of interest on the

Patna High Court CWJC No.3943 of 2017 dt.03-07-2019 2/2 delayed payment of the amount under the head of group insurance.

It is submitted by learned counsel appearing for the State that though he has no instruction but it appears that the amount under the head of group insurance was paid to the petitioner within a year and he is not entitled to any interest. Having heard learned counsel for the petitioner and learned AC to AAG 15 for the State, this application is disposed off giving liberty to the petitioner to file a representation alongwith a copy of this order before the respondent concerned for payment of statutory interest payable, if any on the delayed payment of the amount of group insurance on account of the death of his wife. In case any statutory interest is found payable to the petitioner on the amount of group insurance, the same shall be paid to him within a period of four months from the date of receipt/production of a copy of this order or else the denial of the same shall be communicated to the petitioner within the same period.

Writ application stands disposed of.
