Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks regular bail in connection with Sitamarhi P. S. Case No. 523 of 2021 registered for the offence punishable under Sections 414 and 120(B) of the Indian Penal Code and Sections 30(a), 36, 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the there is recovery of 647.535 litres of illicit liquor and also the petitioner is in custody since 12.12.2022.

Learned APP has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.32260 of 2023(2) dt.22-05-2023 2/2 Considering the nature of allegation levelled against the petitioner and his period of custody, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. II, Sitamarhi in connection with Sitamarhi P.
