Mr.Asha Devi, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-05-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are in custody in connection with Chautham P.S. Case No. 179 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that in the instant case total 3370 liters liquor was seized. He further submits that in the instant case other accused, namely, Avinash Kumar, Shailendra Singh, Manish Kumar, Rajeev Kumar, Shiv Kumar Singh have been granted bail in Criminal Misc. No.66082 of 2018, 64135 of 2018, 69436 of 2018, 69153 of 2018, respectively vide orders dated 05.11.2018, 07.12.2018, 17.12.2018 and 22.11.2018 by different Benches of this Court.

Patna High Court CR. MISC. No.29574 of 2019(2) dt.03-05-2019 2/2 Learned counsel further submits that petitioners are in custody since 23.03.2019.

Considering the fact that in similar circumstance other co-accused have been granted bail by different Benches of this Court, the Court is inclined to grant bail to the petitioners. Let petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise, Khagaria, in connection with Chautham P.S. Case No.179 of 2018 with the condition that one of the bailors should be the elected representative of the local body.
