2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 323, 324, 307, 504, 506 of the Indian Penal Code.
3. Allegation against the petitioner along with coaccused persons is of assaulting the informant and his son due to which they sustained injury. The alleged occurrence took place over a dispute between parties.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Both the parties are neighbours to each other. The petitioner has falsely been implicated in this case. There is no specific overt-act against the petitioner rather general and omnibus allegation
Patna High Court CR. MISC. No.35771 of 2024(2) dt.16-05-2024 2/2 against him. It is further submitted that the petitioner is languishing in judicial custody since 29.2.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bihpur P.S. Case No. 370 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Naugachia (Bhagalpur).
