The petitioner seeks bail in a case registered under Sections 386, 387, 447, 427, 120B/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that on 06.12.2017 a mobile call has come on informant's mobile and demanding ransom by him and threatened to the informant. Two men came in front of his shop and fired four rounds on his show room and after hearing of firing sound the informant hidden himself and in firing computer table destroyed and two other accused present there on motorcycle and thereafter they fled away giving threatening to him.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.29553 of 2019(4) dt.27-08-2019 2/2 the petitioner is in custody sine 28.03.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Danapur, Patna in connection with Bihta P.S. case No.1058 of 2017.
