The petitioner seeks bail in Rajepur P.S. case no. 199 of 2018 instituted for the offence under Sections 489B, 489 ( c), 420,471,374 and 120B/34 of the IPC.

It is alleged that police on secret information reached house of one Sheo Shankar Jha at village Madhuahan Brit and saw one person was sitting on a cot in the Veramda of that house with a bag. He tried to run away on seeing the police. He was apprehended by the police and, on interrogation, he disclosed his name as Indra Kishore Chaudhary ( petitioner). The police recovered Rs. 18,900/- of various denominations of counterfeit notes from his possession. The apprehended accused also disclosed that he had brought same notes from Sachchita Prasad Kushwaha of village Neknema P.S.

Patna High Court CR. MISC. No.31790 of 2019(4) dt.06-08-2019 2/2 Siwai Patti Dist. Muzaffarpur. The informant further alleged that, on query, peitioner disclosed that earlier two times also he carried the fake currency notes and delivered to Kalawati Devi @ Saroj Jha wife of Shoe Shankar Jha of village Madhuahan Brit P.S. Rajepur and had taken original note after deducting commission. He has come for the third time. He has further disclosed that fake note was given to him by one Sachchita Prasad Kushwaha and their two sons whose name he does not know.

In this manner, from the written report it is apparent that police apprehended the petitioner with huge quantity of counterfeit currency notes. From own statement of informant it appears that he had come for the third time to the house of Sheo Shankar Jha with counterfeit note. Therefore, this Court is not inclined to grant bail to the petitioner at this stage.

The prayer for bail of the petitioner stands rejected. Trial Court is directed to expedite the trial. The petitioner will be at liberty to renew prayer for bail after six months in the event no substantive progress is made in the trial. (Sanjay Priya, J) shyambihari/- U T
