2. The petitioner apprehends her arrest in connection with Supaul P.S. Case No. 60 of 2026, registered for the offence punishable under Sections 80, 123, 3(5) of B.N.S.
3. The case of the prosecution, in short, as per the informant is that the marriage of the sister of the informant was solemnized with Md. Abdul Ahad about 8 months ago as per the Muslim Rites and Customs and in the said marriage, the
2/4 informant has given the sufficient dowry. After sometime of her stay at her matrimonial home, her husband Abdul Ahad and his parents namely Md. Tufani and Sairun Nisha have started torturing her Rs.5 lakh as dowry and also threatened her. The informant further alleged that before two days of the incident, the deceased Nushrat Praveen has informed him on telephone that family members of her matrimonial home have tortured her for the demand of dowry. On 26.01.2026 at about 05:30 P.M., the informant has received the information from a villager that Nushrat Praveen is admitted in a clinic at Supaul. Thereafter, the informant and his family members have reached at the clinic of Dr. B.K. Yadav, where it was came to the knowledge of the informant that his sister has died due to the consumption of poison.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He further submits that she has falsely been implicated in the present case. The petitioner is the mother-in-law of the deceased and has no concerned with the alleged occurrence. He further submits that the husband of the deceased is in custody and the petitioner has no criminal antecedent.
5. Learned A.P.P. for the State and learned counsel for
3/4 the informant vehemently oppose the prayer of anticipatory bail.
6. The petitioner is the mother-in-law of the deceased. Admittedly, the husband of the deceased has surrendered and is in custody. The petitioner otherwise has clean antecedent and is a lady aged about forty-six years. Under these circumstances, this Court is inclined to grant privilege of anticipatory bail to the petitioner.
7. Let the petitioner, named above, in the event of her arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Supaul P.S. Case No. 60 of 2026, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and subject to the further condition that:- (i) the petitioner shall co-operate in the investigation/trial.
(ii) the learned Court would, however, verify the criminal antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the Court below shall take step for cancellation of bail bond of the
