1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Dumariya Police Station Case No. 84 of 2023, dated 29.07.2023, disclosing offences punishable under Sections 147/148/149/323/307/332/333/353/153-A/295A/296/504/506 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report lodged by the Circle Officer, is that during the Moharram procession, two communities started brick batting on each other and when the police tried to pacify the matter, the accused persons, including the petitioners, assaulted the police party, due to which they sustained injuries.
4. Learned Counsel for the petitioner submits that the
Patna High Court CR. MISC. No.30030 of 2025(2) dt.15-05-2025 2/3 petitioner is innocent and has falsely been implicated in this case merely on suspicion. He further submits that the allegation levelled in the First Information Report is general and omnibus in nature and there is no overt act alleged against anyone. He further submits that the petitioner is not having any criminal antecedent and similarly situated co-accused persons, namely, Upendra Kumar, Bablu, Anuj and Santu (vide order, dated 03.07.2024, passed in Criminal Misc. No. 29168 of 2024) and Alahu and Afroj (vide order, dated 31.01.2025, passed in Criminal Misc. No. 85069 of 2024), have been granted anticipatory bail by a co-ordinate Bench of this Court.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the nature of allegation and the fact that similarly situated co-accused persons have been granted anticipatory bail by a coordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of
Patna High Court CR. MISC. No.30030 of 2025(2) dt.15-05-2025 3/3 four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Dumariya Police Station Case No. 84 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
