Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Madhepur P.S. Case No. 144 of 2020, disclosing offence punishable under Sections 414, 468, 471 read with Section 34 of the Indian Penal Code.

It is the prosecution's case against the petitioners that they were caught by the police with stolen motorcyles bearing forged number plates . They are in custody since 01.10.2020.

Patna High Court CR. MISC. No.41059 of 2021(3) dt.05-01-2022 2/2 Learned counsel appearing on behalf of the petitioners has submitted that all the offences alleged in the F.I.R. are triable by Magistrate. The petitioners have remained in custody for more than a year.

Considering the period of incarceration and the fact that there is no likelihood of early conclusion of trial during these times, this application is allowed.

Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount, each to the satisfaction of learned ACJM, Jhajharpur in Madhepur P.S. Case No. 144 of 2020.
