The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

The prosecution casein nutshell is that the informant has leased out the land bearing khata No. 232, Khesra No. 2794 and 2807 by creating a forged and fabricated lease deed.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in the present case with malafide

It is also submitted that petitioners are bonafide title holder of the land in question having land possession certificate issued by the C.O. and they are the agnates of the maternal grandfather of the informant, to whom the land in question belongs. It is further submitted that the nature of dispute is of Civil in Nature.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, East Champaran, Motihari in connection with Keshariya P.S. Case No. 174 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
