Patna High Court MJC No.2239 of 2016(5) dt.29-07-2025 2/3 ORAL ORDER 29-07-2025 Heard learned counsel for the parties.
2. This contempt petition has been filed alleging violation of judgment dated 03.02.2016, passed in C.W.J.C. No. 13421 of 2015.
3. It has been submitted by learned counsel for the Bihar State Food and Civil Supply Corporation that the order passed in the writ petition has been modified by the Division Bench of this Court vide order dated 06.08.2018, passed in L.P.A. No. 799 of 2016 filed by Bihar State Food and Civil Supply Corporation.
4. Learned counsel for the petitioner submits that the order passed by the Division Bench of this Court in L.P.A. No. 799 of 2016 was challenged by the State before Hon'ble Supreme Court in S.L.P. (C) No. 17509 of 2019, whereby Hon'ble Supreme Court has referred the matter before the District Magistrate of the concerned District for consideration within a period of two months.
5. Accordingly, the order passed in the writ petition, alleging violation of which order this contempt petition has been filed, has been modified by a Division Bench of this Court as well as by Hon'ble Supreme Court.
6. In that view of the matter, there cannot be any
Patna High Court MJC No.2239 of 2016(5) dt.29-07-2025 3/3 violation of the order passed in the writ petition, which stands modified by a Division Bench of this Court as well as by Hon'ble Supreme Court in the case referred to hereinabove.
7. Accordingly, the contempt petition stands closed and disposed off.
