The petitioner seeks bail in Khagaria P.S. Case No. 96 of 2021, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

As per the prosecution case, one country made pistol and five live cartridges have been recovered from possession of this petitioner.

It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner and he is in custody since 03.02.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned

(ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
