Heard learned counsel for the petitioner, learned counsel representing the State of Bihar and learned counsel for Opposite Party No. 2.
This application for regular bail arises out of Banka (Mahila) P.S. Case No. 08 of 2021, disclosing offence punishable under Sections 498 (A) / 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The petitioner is in custody since 08.03.2021. He is alleged to be the husband of the informant which the petitioner
Patna High Court CR. MISC. No.41067 of 2021(3) dt.05-01-2022 2/2 is denying. There is allegation in the F.I.R. of demand of dowry and physical and mental torture for non-fulfillment of such demand by the petitioner and his family members. Learned counsel appearing on behalf of the petitioner has submitted that apparently it is a matrimonial dispute and as a matter of fact, the alleged marriage of the petitioner with the informant is not being accepted by the petitioner, he deserves to be enlarged on bail.
Considering the nature of accusation, in my opinion, case of grant of regular bail is made out. This application is allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount, each to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka in Banka (Mahila) P.S. Case No. 08 of 2021.
