The petitioner seeks bail in anticipation of his arrest in connection with Khushrupur P.S. Case No. 169 of 2019 instituted for the offences under Sections 147, 148, 149, 386, 387, 504, 506, 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

The First Information Report clearly reflects that the miscreants/ marauders opened fire and killed one person. The purpose of resorting to this act of vandalism is stated to be the non-payment of protection money. So far

Patna High Court CR. MISC. No.30372 of 2020(3) dt.02-02-2021 2/2 as the petitioner is concerned, he is only said to have driven the vehicle in which the other miscreants were seated. It has been argued that during the course of investigation, an eye-witness reported that the petitioner was standing outside the gate when the occurrence was being committed by the other accused persons.

However, considering the entire circumstance of the case, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected. In case the petitioner surrenders before the court below and seeks bail, it shall consider that application on its own merits without being prejudiced by the fact that the present petition has not been entertained.

This application stands dismissed.
