The petitioner seeks bail in Sessions Trial No 446 of 2017 arising out of Revilganj Police Station (for brevity, PS) Case No 91 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307, 504/34 of Indian Penal Code (for brevity, IPC) in which later on Section 302 of IPC has been added.
As per report dated 26.08.2022, the matter is now fixed for final argument. The report states that the defence and prosecution witnesses have been examined and the sole surviving accused's statement under Section 313 of Criminal
Patna High Court CR. MISC. No.31836 of 2022(4) dt.12-10-2022 2/2 Procedure Code has also been recorded.
In view of the trial having attained near conclusion, this Court does not find any reason to grant bail to the petitioner. Earlier also, his prayer for bail has been rejected after due consideration on 03.05.2018 in Cr Misc No 16704 of 2018. In view of the above noted facts and circumstances, this Court is not inclined to take a different view. Prayer for bail is again rejected.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
