The petitioner seeks bail in Bela P. S. Case No. 48 of 2019 instituted for the offence under Section(s) 379, 467, 468, 414/34 of the Indian Penal Code.
Learned counsel for petitioner submits that there is no any separate case lodged by anybody about the stolen motorcycle said to have been recovered from possession of this petitioner.
In the written report, it is alleged that police got information that this petitioner indulged in sale and purchase of stolen motorcycle. Thereafter, the police raided the house and found petitioner along with two other accused persons as named in the written report and three motorcycles have been recovered.
Patna High Court CR. MISC. No.32798 of 2019(2) dt.17-05-2019 2/2 It was disclosed before the police that those motorcycles have been brought by Vinod Sahni and Binod Rai. Learned counsel further submits that co-accused , namely, Vinod Sahni has already been granted regular bail by this Court by order dated 8.5.2019 passed in Cr. Misc. no. 30192 of 2019. Petitioner is in custody since 1.3.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Sitamarhi in connection with Bela P. S. Case No. 48 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
