The petitioner apprehends his arrest in connection with Mahila (Bhabua) P.S. Case No. 25 of 2021 registered under Section 376 and other allied sections of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case to grab the share of the petitioner. Further he submits that the certificate of the Doctor (Annexure2) shows that petitioner is a chronic patient of Hepatitis-B since 2012. It is also submitted that Annexure-3, informatory petition shows that father of the petitioner was receiving threat and undue pressure and in connivance with his own son to reside separate in another ancestral house so that they may control the

Patna High Court CR. MISC. No.41323 of 2021(2) dt.03-03-2022 2/2 entire property of the petitioner's family. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the 1st Additional District Judge-cumSpecial Judge, Kaimur at Bhabua in connection with Mahila (Bhabua) P.S. Case No. 25 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C. shailendra/- (Arvind Srivastava, J) U T
