2. Petitioner seeks pre-arrest bail in connection with N.D.P.S. Case No. 13/2024 arising out of N.C.B. (Crime) Case No. 05/2024 registered for the offence punishable under Sections 8(c), 21(c), 27A and 29 of the NDPS Act.
3. On secret information, informant who was Inspector in the Narcotics Control Bureau, Patna, raided a train and recovered 9 thousand liters cough syrup.
4. Learned counsel for the petitioner submits that petitioner's name has surfaced in the present case on the basis of confessional statement of the co-accused namely Ravibhai Kediya who is alleged to have kept the prohibited medicine (cough syrup) in the train. Petitioner has got no criminal antecedent.
5. Learned counsel for the NCB, Patna opposes the prayer for bail. He submits that the quantity of seized prohibited medicine (cough syrup) was more than permissible limit and during investigation it has come that petitioner and other accused persons were indulged in this illegal activity. Prayer for
Patna High Court CR. MISC. No.41348 of 2025(5) dt.25-09-2025 2/2 bail of co-accused, with similar allegation, has already been rejected by a co-ordinate bench of this Court vide order passed in Cr. Mis. No. 60836/2025.
6. Considering the nature of accusation and huge quantity of recovery of cough syrup, prayer for bail of the petitioner is rejected.
