2. The petitioner apprehends his arrest in connection with Banmankhi P.S. Case No.452 of 2022 instituted under Sections 341, 323, 498A & 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and his family member assaulted the informant due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.35325 of 2024(5) dt.22-11-2024 2/3 case. He further submits that petitioner is ready to keep his wife with him. The petitioner has no criminal antecedent and he undertakes to co-operate in the trial and he is also ready to make payment of Rs.3,000/- per month for maintenance of his wife.
5. Learned A.P.P. for the State and learned counsel for the informant submit that the mediation/conciliation between the parties failed.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Purnia / Concerned Trial Court in connection with Banmankhi P.S. Case No.452 of 2022, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973, with further following condition(s):
(i) Petitioner shall make the payment of Rs.3,000/- per month to the informant.
7. The Trial Court shall take steps for conciliation between the both parties and both parties shall also co-operate in
Patna High Court CR. MISC. No.35325 of 2024(5) dt.22-11-2024 3/3 such conciliation.
