Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case for the offence registered under Sections 420, 409, 406, 467, 468 and 120(B) of the I.P.C.
The prosecution story, in brief, is that the accused persons embezzled the government money after opening forged National Child Labour Schools in the name of providing education, dress and food to the students.
Earlier bail application of the petitioner was rejected
Patna High Court CR. MISC. No.30819 of 2020(3) dt.20-01-2021 2/3 by this Court vide Cr. Misc. No. 56552 of 2019 under order dated 14.11.2019 with an observation 'at this stage'. In pursuance to the said observation, the present bail application has been filed on behalf of the petitioner.
A report was called for from the court below. It has been reported that the charge has been framed but no prosecution witness has been examined till date in this case. It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 12.06.2019. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no chance of trial being concluded in near future. No wrongful gain has been made on behalf of the petitioner. The petitioner was simply an employee of the N.G.O. in question.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.30819 of 2020(3) dt.20-01-2021 3/3 satisfaction of the learned C.J.M., Madhepura, in connection with Madhepura P.S. Case No. 252 of 2015.
