JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-10-2018 The petitioner seeks modification of the order dated 07.09.2018 passed by this Court in Cr. Misc. No. 53337 of 2018, whereby he was granted bail in connection with Bhagalpur Kotwali P.S. Case No. 345 of 2017 on his furnishing bonds in the sum of Rs. 10,000/- with two sureties of the like amount and on his further depositing a draft of Rs. 5,00,000/- before the Court of learned Chief Judicial Magistrate, Bhagalpur, which was to be invested in an interest bearing scheme by the Court below with an auto renewal facility.

The learned counsel appearing on behalf of the petitioner submits that in compliance of the order dated

Patna High Court Cr.Misc. No.53337 of 2018 (3) dt.26-10-2018 2/2 07.09.2018 referred to above, the petitioner had deposited a draft of Rs. 5,00,000/- before the learned Chief Judicial Magistrate, Bhagalpur, but he was granted only provisional bail as the aforesaid amount could not be converted into an interest bearing fixed term deposit with auto renewal facility. For it to be invested in any interest bearing scheme, the draft has to be encashed.

Under such circumstance, learned counsel for the petitioner seeks modification of the aforesaid order dated 07.09.2018 to the extent that the learned Chief Judicial Magistrate, Bhagalpur be directed to encash aforesaid draft and, thereafter, invest in an interest bearing scheme with auto renewal facility.

Considering the submission as above, the order dated 07.09.2018 is modified to the extent indicated above giving the liberty to the learned Chief Judicial Magistrate, Bhagalpur to get the draft encashed and the money invested in an interest bearing scheme as directed by this Court on 07.09.2018.

The order dated 07.09.2018 stands modified accordingly.

The application is allowed.
