The petitioner seeks regular bail in connection with Bausi P.S. Case No. 144 of 2018 for the offence registered under Sections 467, 468, 471, 420 and 120(B) of the I.P.C. As per prosecution case, the allegation against the petitioner is that he made a false injury report on the basis of the photo-copy of the CT Scan produced by Md. Parwez due to which the father of the informant and others were convicted in ST No. 104 of 2019.
Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. The co-accused namely Md. Tabrez and Md. Parwez have been granted anticipatory bail by a coordinate
Patna High Court CR. MISC. No.33737 of 2023(2) dt.24-06-2023 2/2 Bench of this Court passed in Cr. Misc. No. 61062 of 2019 and Cr. Misc. No. 13545 of 2019 respectively. He further submits that petitioner is a doctor and it is stated in the supplementary affidavit that he has no criminal antecedent. Petitioner is in custody since 15.04.2023 without his fault.
Learned counsel appearing on behalf of the State opposes the prayer for grant of regular bail to the petitioner. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in Bausi P.S.
