2. The petitioner seeks bail in connection with Haraiya P.S. Case No. 15 of 2025 registered for the offence punishable under Sections 137(2)/96 and 144 of the BNS and Section 79 of the Juvenile Justice (Care and Protection) Act.
3. As per the F.I.R., on 05.02.2025, during an antihuman trafficking operation, a minor girl (victim) was found with an adult male (petitioner) under suspicious circumstances. On query, the girl stated that she had been talking to the petitioner on phone for a week and he had promised to send her money and lured her to travel to Nepal for marriage without informing her family.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

It is submitted that the victim girl was examined under Section 183 of the BNSS wherein she has unequivocally stated that she was neither lured nor abducted by the petitioner and had voluntarily accompanied him. It is further submitted that the victim denied for medical examination. She disclosed her age as 19 years. Petitioner is in custody since 06.02.2025 having no criminal antecedent.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and also the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari/concerned court in connection with Haraiya P.S. Case No. 15 of 2025.
