Let the defect(s), if any, be removed within two weeks of the complete start of the physical Court in normal course. The petitioner, who is in custody since 25.10.2019, seeks regular bail in connection with Katihar Nagar P.S. Case No. 698 of 2019 for the offence punishable under Sections 326/307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the prayer for bail of the petitioner was rejected vide order dated 08.09.2020 passed in Cr. Misc. No. 20103 of 2020.

The trial court vide its Letter No. 14 dated 22.01.2022 has reported that the trial has already proceeded. As such this Court is not of the opinion to release the petitioner on bail at this

Patna High Court CR. MISC. No.40887 of 2021(3) dt.31-01-2022 2/2 stage. It is, however, observed that the court below shall conclude the trial expeditiously well within a period of one year from the date of communication of this order. If no substantial progress takes place in the trial within the aforesaid period, the petitioner, if so advised, may renew his prayer for bail.
