1. Heard the parties.
2. The petitioner seeks regular bail in connection with Janki Nagar P.S. Case No. 411 of 2025 registered for the offence punishable under Sections 317(2), 317(4), 317(5) & 111 of the BNS.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the prosecution has failed to establish that the recovered mobile phones were stolen property and there is no material to show identification or corroboration regarding the alleged stolen articles. Learned counsel further submits that the recovered mobile phones were found active and functional, which itself creates doubt regarding the prosecution story. It is also submitted that no offence under Sections 303,
Patna High Court CR. MISC. No.32064 of 2026(2) dt.12-05-2026 2/2 111 and 317 of the BNS is made out against the petitioner. The petitioner is in custody since 31.12.2025.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the petitioner's custody period and the completion of investigation against him, this court is inclined to enlarge the petitioner on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Janki Nagar P.S. Case No. 411 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
