JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Andhrathari P.S. Case No. 48 of 2018 registered under Sections 379, 307 and other allied Sections of the Indian Penal Code.
The accusation is that 14 persons named in the F.I.R. including the petitioner started to cause assault to the informant, Raghunandan Sah, in course of returning from tea shop in the evening of 08.05.2018.
Learned counsel for the petitioner submits that due to land dispute occurrence of Marpit took place, in which, petitioner's side also sustained injury, regarding which,
Patna High Court Cr.Misc. No.54765 of 2018(2) dt.10-10-2018 2/2 Andhrathari P.S. Case No. 49 of 2018 is also instituted on the basis of written statement of co-accused, Chandan Kumar. Further submission is that moreover, injuries, as found on the person of informant, is simple in nature and petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-III, Jhanjharpur, in connection with Andhrathari P.S. Case No. 48 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
