Mr. A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-03-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bangaon P.S. Case No. 45 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Only on the confessional statement of co-accused, the name of the petitioner has been transpired in this case. Further submission is that nothing has been recovered from the possession of the petitioner. Petitioner is a man of clean antecedent.

Having considered the facts and circumstances of the

No.30225 of 2020(2) dt.01-03-2021 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Saharsa in connection with Special (Excise) Case No. 260 of 2020 arising out of Bangaon P.S. Case No. 45 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
