The petitioner seeks bail in Shivsagar P.S. Case No. 361 of 2018, instituted for the offence under Section(s) 364A of the Indian Penal Code. Subsequently, Sections 302, 201 and 120-B of Indian Penal Code were added.

Counsel for the petitioner submits that petitioner is not named in the written report.

It is alleged in the written report that son of the informant namely, Amit Kumar, told his mother that he is going to meet someone who called him from Mobile No. 7654790592 and 9110194882, but he did not return. It is further alleged that during search, one call was received by the informant from Mobile No. 8298295093. The caller was demanding ransom

Patna High Court CR. MISC. No.30067 of 2019(4) dt.12-07-2019 2/2 money of Rs.8,00,000.

Counsel for the petitioner submits that dead body of son of informant was found in the river on the basis of confessional statement of co-accused Jay Kumar Singh and others. He further submits that name of petitioner has come during investigation in the confessional statement of co-accused Santosh Kumar who has already been granted bail by this Court vide order dated 8.5.2019 passed in Cr. Misc. 29841 of 2019. Petitioner is in custody since 9.11.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Shivsagar P.S. Case No. 361 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
