1. Heard the parties.

2. Mr. Bipin Bihari Singh, learned counsel for the petitioner, submits that in the light of Raghavendra Sharma case, the Respondent/Authority has not considered the case of the petitioner for promotion.

3. Learned counsel for the State, referring to paragraph 13 and 14 of the supplementary counter affidavit, submits that if the representation is filed by the petitioner before D.E.O., Saran, the same shall be considered by D.E.O. in the light of the judgment passed by this Court in Raghavendra Sharma case.

4. In reply, learned counsel for the petitioner submits

Patna High Court CWJC No.9079 of 2016(12) dt.07-10-2025 2/2 that petitioner has already filed his representation.

5. Be that as it may, the petitioner is directed to file a fresh representation before the D.E.O., Saran, within a period of two weeks. If such a representation is filed, the D.E.O., Saran, shall consider the same in accordance with law and in the light of the judgment passed by this Court in Raghavendra Sharma case, within a reasonable time frame, preferably within a period of five months from the date of submission of the representation by the petitioner.

6. With the aforesaid direction, this writ application stands disposed.
