====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-05-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Jehanabad (Town) P.S. Case No. 170 of 2024 dated 27.02.2024 registered for the offence punishable under Section 394 of the I.P.C.

3. As per the prosecution case, on 27.02.2024 at 3.45 A.M., the informant alongwith his four friends were going to Manglahat for purchasing animals by his Pick-up Van bearing Registration No. BR-01GM-9426. When he reached flyover bypass which is ahead of Jehanabad Rajabazar then four persons riding on two motorcycles surrounded him. It is further alleged that they were having pistols in their hand and pointed

No.34211 of 2024(2) dt.13-05-2024 2/3 that pistol on his temple and by touching the pistol with the body of one of the persons of the informant, demanded money and threatened to kill if the demand is not fulfilled by them. All the accused persons had covered their faces. Thereafter, the informant protested, upon which, a boy assaulted him with butt of the gun causing head injury. It is further alleged that they also took Rs. 7,00,000/- in cash from the Pick-up Van. They also assaulted them and took mobile bearing No. 8084178183 of the informant and key of the Pick-up Van.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is not named in the F.I.R. The petitioner was arrested from his house and no incriminating article has been recovered either from his house or from his possession. The petitioner has not been put on T.I. Parade. The petitioner has two criminal antecedents in which he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 05.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be

No.34211 of 2024(2) dt.13-05-2024 3/3 enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Jehanabad (Town) P.S. Case No. 170 of 2024.

7. The application stands allowed.
