Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 401,143,141 of the Indian Penal Code and section 25(1-B)(1AA) 26, 35 of the Arms Act As per allegation in the F.I.R, eight to ten persons along with petitioner were assembled for committing crime. When police reached co-accused persons fled away but one Foroz Alam@ Baba was caught.

Learned counsel for the petitioner submits that petitioner has falsely implicated in this case. The name of petitioner transpired in this case on the basis of confessional statement of co-accused Foroz Alam. Petitioner has got no
