2. Petitioner is accused in connection with Kiul P.S. Case No. 27 of 2022 registered under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is alleged that all the accused persons including the petitioner have committed murder of the father-in-law of the informant due to previous enmity.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that during course of investigation, coaccused Shiva Kumar has confessed that he has committed murder of the deceased and pursuant to the confessional
Patna High Court CR. MISC. No.36175 of 2024(2) dt.17-05-2024 2/2 statement of the co-accused, the arms have been recovered from the place of occurrence which was used in the present occurrence. The police after investigation has submitted final form against this petitioner. It is next submitted that similarly situated co-accused Manikant Yadav has already been granted bail by this Court vide order dated 03.05.2023 passed in Cr. Misc. No. 74191 of 2022. The petitioner is in custody since 01.04.2024.
5. Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Kiul P.S. Case No. 27 of 2022.
