The petitioner apprehends her arrest in Raxaul Rail P.S. Case No.37 of 2019 registered under Sections 304B and 34 of the Indian Penal Code.

The informant (mother of the deceased) alleged that her daughter was married to Salim Ansari in the year 2016. The husband and other in-laws of her daughter subjected her to physical and mental torture. The informant informed her son-inlaw, who is residing in Delhi and he assured her to settle the dispute when he would come on the eve of Bakrid. On 23.06.2019 the daughter of the informant came to Addapur Railway Station and committed suicide by coming in front of a running train.

Patna High Court CR. MISC. No.37906 of 2020(2) dt.01-07-2021 2/2 Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased. The deceased herself committed suicide. There is no allegation of demand of dowry and torture. The petitioner has no manner of concern with the deceased and her husband. The deceased never complained any ill-treatment at the hands of the petitioner. Taking into consideration the facts that the deceased herself committed suicide by coming in front of a running train and the petitioner is the mother-in-law of the deceased, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bettiah, West Champaran in connection with Raxaul Rail P.S. Case No.37 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
