Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

Earlier the prayer for bail to the petitioner was refused by a detailed order in Cr. Misc. No.73666 of 2019 on merit of the case.

Learned counsel for the petitioner submits that there was error of record while considering the evidence of witnesses when this Court had refused the prayer for bail to the petitioner.

Patna High Court CR. MISC. No.41701 of 2021(3) dt.15-12-2021 2/2 The report of the learned trial Judge would reveal that due to non-cooperation of the accused persons the charges have not been framed as yet.

Considering the nature of allegation of commission of murder of arrested person while in police custody, I am not inclined to enlarge him on bail in connection with Dumra P.S. Case No.91 of 2019. Hence, prayer for bail is refused. (Birendra Kumar, J) Mkr./- U T
