Let the defect(s), if any, be removed within two weeks of the complete start of the physical Court in normal course.

The petitioner seeks regular bail in connection with Phulwarisharif P.S. Case No. 767 of 2019 for the offence punishable under Sections 498A/506 of the Indian Penal Code. It is submitted by Mr. Abhay Kumar Singh, learned counsel appearing on behalf of the informant that Rs. 3,57,000/- (Rupees three lacs and fifty seven thousand) has already been

Patna High Court CR. MISC. No.42681 of 2021(7) dt.12-04-2022 2/3 either deposited in the account of the informant who is the wife of the petitioner or the same has been handed over to him in Court by the petitioner.

Mr. Amrendra Kumar, learned counsel appearing on behalf of the petitioner handed over two bank drafts to Mr. Abhay Kumar Singh, learned counsel for the informant, in Court, one bank draft for Rs.1,00,000/- bearing Sl. No. '145412' dated 07.04.2022 issued by Central Bank of India and other for Rs.30,000/- bearing Sl. No. '003414' dated 08.04.2022 issued by IDBI Bank.

This Court would appreciate the efforts taken by Mr. Abhay Kumar Singh, learned counsel appearing on behalf of the informant and Mr. Yogesh Chandra Verma, learned Sr. Counsel appearing on behalf of the petitioner assisted by Mr. Amrendra Kumar.

Mr. Amrendra Kumar, learned counsel for the petitioner submits that now all the demands of the informant have been fulfilled and nothing is due to be paid to the informant. Mr. Abhay Kumar Singh, learned counsel for the informant has raised no objection.

Considering the aforementioned facts and circumstances of the case, the petitioner, above named, is

No.42681 of 2021(7) dt.12-04-2022 3/3 directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IX, Patna in connection with Phulwarisharif P.S. Case No. 767 of 2019, subject to the following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature of offence, after his release on bail, the trial Court shall take steps to cancel his bail bonds.
