The petitioner seeks regular bail in connection with Sessions Trial No. 07 of 2021, arising out of Ekangarsarai Police Station Case No. 72 of 2019, registered for the offences punishable under Sections 304-B/34 of the Indian Penal Code. It is a case of dowry death and the petitioner is the husband of the deceased. The allegation is that within two years of marriage, the daughter of the informant has been killed by the petitioner and his family members, due to non-fulfillment of demand of dowry.
Learned Counsel for the petitioner submits that the petitioner is in custody since 26.02.2020 and the trial has

This Court, vide order, dated 31.01.2022, had called for a report from the learned Court below regarding the stage of the case and in pursuance of the said order, a report has been submitted by learned 1st Additional Sessions Judge, Hilsa, Nalanda and from perusal of the same, it would be evident that out of seven chargesheeted witnesses, five have been examined and only two witnesses are yet to be examined. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the materials on record and the fact that the trial is at the verge of conclusion, I am not inclined to grant regular bail to the petitioner, at this stage.
This application is, accordingly, dismissed.
However, the petitioner may renew his prayer for bail after six months from today, if the trial does not show any progress.
