JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-12-2021 Heard the learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Mohania P.S. Case No. 146 of 2020 registered for the offence punishable under sections 341, 323, 307, 34 of the Indian Penal Code.

As per allegation, the accused persons attacked the informant and they badly assaulted him. Allegation against the present petitioner is that he has inflicted rod blow on the left hand of the informant.

Patna High Court CR. MISC. No.30201 of 2020(7) dt.14-12-2021 2/2 The learned counsel for the petitioner has submitted that there is a land dispute between the parties and due to that scuffle took place between them.

On the other hand, the learned Additional Public Prosecutor has submitted that there is a specific allegation against the petitioner that he has inflicted rod blow on the person of the informant, who sustained grievous injury. Considering the fact that there is a specific allegation against the petitioner of inflicting rod blow on the person of the informant, who sustained grievous injury, I do not think it a fit case for anticipatory bail and accordingly it is dismissed. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
