====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-07-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 447, 341, 323, 379, 307, 504/34 of the Indian Penal Code.
3. As per the F.I.R., this petitioner along with other accused persons, came at the house of informant and assaulted him by means of lathi and danda. It is further alleged that the accused persons snatched cash from the pocket of informant and and this petitioner is alleged to have snatched gold chain from his neck.
4. Learned counsel for the petitioner submits that both parties are co-villagers and land dispute is going on between them and due to this reason, a simple Maarpeet took place. Allegation of assault is general and omnibus. There is no
Patna High Court CR. MISC. No.30027 of 2025(2) dt.16-07-2025 2/2 specific allegation of overt act against petitioner. Rest of the allegations are ornamental to make the case grave.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering backdrop of the case and nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P. S. Case No. 849 of 2022, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
