The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 461,379, 411 of the Indian Penal Code .

As per prosecution case, the allegation has been made against the petitioner is that he along with other co-accused persons stole the articles from shop of the informant and they were allegedly apprehended on spot.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. It is further submitted vide para 8 of the petition that the informant is not an eye-witness to the alleged occurrence and he reached

From perusal of seizure list, it appears that signature or L.T.I. of the petitioner has not been mentioned whereas, the informant stated that the petitioner was caught by the local people with stolen articles. It is further submitted that the petitioner is languishing in judicial custody since 11.1.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhagwanpur P.S. Case No. 7 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai.
