2. The petitioner seeks bail in connection with Supaul (Laukha O.P.) P.S. Case No. 1214 of 2022 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

3. As per prosecution case, petitioner and others are said to have committed the murder of informant's daughter.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. Petitioner bears no criminal antecedent. Petitioner is in custody since 11.01.2023.

5. The learned A.P.P. for the State vehemently opposed

No.34882 of 2024(3) dt.13-09-2024 2/2 the prayer for bail of the petitioner submitting that in para-11 and 12 of the case diary witnesses have supported the case of the prosecution. He further submits that reason behind the occurrence is that petitioner being husband is said to have illicit relation with his Bhabhi and on account of said relation, victim/wife was assaulted, who succumbed to the injury and postmortem report is quite explicit with regard to number of injury and nature of injury sustained by the deceased.

Considering the facts and circumstances of the case, nature of allegation levelled against the petitioner coupled with postmortem report as well as material available on record, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected.
