JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Barhara (Krishnagarh) P.S. Case No.268 of 2021, registered for the offence punishable under Sections 302, 506, 34 of the Indian Penal Code.

The petitioner is named in the First Information Report. There is allegation against the persons named in the First Information Report that they had intercepted the deceased and thereafter, there is specific allegation against co-accused Lavkush Yadav of having assaulted the deceased with an iron rod in his head leading to serious injuries and his death. Learned counsel appearing on behalf of the petitioner appears to be correct in his submission that there is no

Considering the nature of accusation in the First Information Report, in my opinion, case for grant of regular bail in favour of the petitioner is made out. This application is accordingly allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara, in Barhara (Krishnagarh) P.S. Case No.268 of 2021.
