2. The petitioners apprehend their arrest in connection with Complaint Case No. 423C of 2021 registered under Sections 420, 406 and 120(b) of the Indian Penal Code.

3. As per complaint case, it is alleged that despite taking consideration money of Rs. 1,00,000/- petitioners did not execute the sale deed in favour of the complainant nor return the consideration money and they have executed their land secretly to one Abhinandan Yadav by sale deed No. 1766 dated 10.03.2021.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that the dispute involved in the present complaint case is with regard to sale and purchase of land which is purely civil in nature, none of the acts allegedly committed by the petitioners gave rise to any criminal liability. Petitioners claim clean antecedent.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Supaul in connection with Complaint Case No. 423C of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
