Mr.Upendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner never obtained any piece of paper/receipt by putting forged signature of informant and never became the member on the basis of the said receipt. He further submits that the FIR is vague and no specific allegation has been made against the petitioner. Moreso, the matter relates to the election dispute for which Election Case No.200/2020 is already pending consideration before this Court.

Learned counsel appearing for the State as well as the

Patna High Court CR. MISC. No.43491 of 2021(3) dt.21-06-2022 2/2 informant oppose the prayer for bail.

Considering the nature of allegation, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Vaishali Sadar Police Station Case No. 1120 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
