1. Heard learned counsel for the parties concerned.

2. The petitioner has filed the present writ application for quashing the letter dated 16.12.2016 vide letter no. 1280 as contained in Annexure 13, whereby Executive Officer, Nagar Panchayat, Kowath, has cancelled the appointment of the petitioner in the light of the order dated 12.11.2016 passed by District Teachers Appellate Authority, Rohtas

Patna High Court CWJC No.4308 of 2017(5) dt.27-06-2024 2/2 in Appeal No. 11 of 2016 as contained in Annexure 12/1. The petitioner has directly approached this Court without approaching the State Appellate Authority.

3. In view of the nature of dispute, the petitioner is granted liberty to approach the State Appellate Authority, by filing an appeal, against the order passed by District Teachers Appellate Authority, Rohtas.

4. It is made clear that if an appeal is filed by the petitioner within a period of four weeks from today, along with a petition for condonation of delay, the State Appellate Authority shall consider the same and pass a reasoned order, in accordance with law.

5. With the aforesaid observations and directions, the writ application is disposed.
