Petitioner seeks bail in Mirganj P.S. Case No.297 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that total 164 litres foreign liquor was recovered. Two persons, namely, Dhanu Kumar Rai and Gharbharan Mahto were arrested. They disclosed the name of this petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 26.03.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

No.28774 of 2019(2) dt.06-05-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Excise, Gopalganj, in connection with Mirganj P.S. Case No.297 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. It appears from para 3 that one more case under the Excise Act is pending against the petitioner. The petitioner will file an Affidavit at the time of his furnishing bail bond that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will liable to be cancelled.
