JUSTICE SUDHIR SINGH ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 147, 148, 149, 341, 323, 332, 333, 307, 353, 436, 427, 504, 115 of the IPC, 27 of the Arms Act and 3⁄4 of Prevention of Public Properties Act. The prosecution story, in brief, is that Guddu Rai in police custody in Daudpur P.S. Case No. 143 of 2017. He became ill and subsequently died during treatment in PMCH. Thereafter, the villagers started agitation and also caused obstruction of the traffic by road jam and demanded compensation. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to mistake of fact. 30 persons have been named in the F.I.R. alongwith 300-400 unknown persons. A protest is alleged to have been made due to custodian death of one Guddu Rai. The local people had protested against the said custodian death. No specific allegation has been made against the petitioner. Other coaccused has been granted anticipatory bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 47476 of 2017 order dated 17.10.2017.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saran at Chapra, in connection with Bhagwan Bazar P.S. Case No. 267 of 2017,
