JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2019 This application, for grant of anticipatory bail, arises out of Abadpur P.S. Case No. 136 of 2018, disclosing offences under Sections 323, 379, 376, 313, 354, 504 and 34 of the Indian Penal Code.
Allegation as per complaint petition is that petitioner and complainant were in live-in relationship for last ten years and she had also become pregnant but her pregnancy was terminated by the petitioner against her will and it is alleged that on the assurance of marriage, the petitioner established physical relationship but did not marry her.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, which will appears from the fact that complainant is major and the

Heard learned A.P.P. as well as learned counsel for the complainant. Learned counsel for the complainant has also submitted that now the matter has been compromised between the parties.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Katihar, in connection with Abadpur P.S. Case No. 136 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
