In this case, the petitioner is seeking anticipatory bail in connection with Bhabua P.S. Case No. 166 of 2005 (Trial No. 972 of 2016), registered for the offence punishable under Sections 25 1(B.A), 26 and 35 of Arms Act.

Allegation has been made that the police has intercepted and arrested two persons and from them a motorcycle along with country made pistol were recovered which was not explained by the accused persons, but the petitioner fled away from there and did not come under the clutches of the police.

Learned counsel for the petitioner submits that after investigation the police submitted final report, but the Judicial

Patna High Court CR. MISC. No.29505 of 2019(2) dt.06-05-2019 2/2 Magistrate has taken cognizance and for the firm NBW has been issued on 28.02.2019. It is urged that petitioner has got no criminal antecedent.

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Kaimur at Bhabua, in connection with Bhabua P.S. Case No. 166 of 2005 (Trial No.972 of 2016), subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
