1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 420, 409 and 406 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and was the Branch Manager of S.B.I. at the time when the occurrence is alleged to have taken place. It is further submitted that Rohit Kumar, the Circle Officer had approached this Court seeking anticipatory bail by filing Cr. Misc. No.55856 of 2022 and the same came to be allowed by an order dated 13.03.2023 passed by the then learned Coordinate Bench. Further, Raju Singh @ Raj Kumar Singh was granted the privilege of anticipatory bail

Patna High Court CR. MISC. No.36882 of 2026(3) dt.21-07-2026 2/3 by an order dated 24.02.2023 in Cr. Misc. No.60861 of 2022, thereafter Santosh Sah @ Sukhari Sah was also granted the privilege of anticipatory bail by order dated 14.07.2023 in Cr. Misc. No.27703 of 2023.

It is next submitted that petitioner based on suspicion came to be implicated with an allegation that he also connived with the accused persons in clearing 13 cheques whose value was Rs.25 Lacs and thus, the accused persons dishonestly misappropriated public money amounting to Rs.49 Lacs. It is submitted that if privilege of anticipatory bail is granted, the petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the fact that co-accused have been granted the privilege of anticipatory bail by the then learned Coordinate Benches, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the

Patna High Court CR. MISC. No.36882 of 2026(3) dt.21-07-2026 3/3 like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Patahi P. S. Case No.22 of 2022, subject to the conditions laid down under Section 482(2) of the B.N.S.S.

7. The application stands allowed.
