JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhargama P.S. Case No. 287 of 2018 registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

Allegation as per FIR is that petitioner and others have collected money from several persons on the plea of providing Bank loan to them of Rs.50,000/- and thereafter informant and others inquired from the Bank and on that Bank officials caught hold of two persons, who succeeded in fleeing away, including the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated and he is resident of same village of informant.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.37453 of 2019(4) dt.25-09-2019 2/2 anticipatory bail stating that witnesses have supported the prosecution during investigation and there are materials against the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail. With the above observation, this application is dismissed.
